What is a U.S. Business Representative (PBR)?
If you're a foreign-based seller, TikTok Shop requires you to designate a Primary Business Representative (PBR) who is a U.S. resident. The PBR provides their government-issued ID, proof of U.S. residence, and Social Security Number to TikTok as the U.S. point of contact for your shop.
Does Acutrack provide or supply a PBR?
No. We do not provide, source, rent, or supply U.S. Business Representatives. The PBR must be someone you identify through your own network — ideally a trusted friend or family member living in the U.S.
Why shouldn't I use a third-party "PBR-for-hire" service?
Because it can quietly put your entire shop at risk.
When one Representative is listed on multiple unrelated sellers' TikTok Shop accounts — which is exactly what most rep-for-hire services do — TikTok's connected-account framework links all those shops together. If any one of those unrelated sellers commits a violation, every shop tied to the same Representative becomes exposed to enforcement review.
Who should I choose as my PBR?
Someone you know personally and trust:
- A U.S.-resident family member, or
- A long-term friend living in the U.S.
They need to be willing to share their ID, address, and SSN with TikTok, and they should understand what the role involves before agreeing.
Before you start the TikTok Shop setup process — and before engaging Acutrack or setting up a U.S. business entity. Identifying your PBR up front prevents downstream problems.
Can I change my PBR later if it doesn't work out?
Practically, no — not without closing your shop. If you start with a PBR you don't know well (for example, someone you paid one time), and you later need to remove them, you generally have to shut the shop down and start over.
This is one of the few decisions in the TikTok Shop setup that cannot be cleanly undone, which is exactly why we recommend you choose someone in your inner circle from day one.
Is my PBR personally liable for taxes on the shop's sales?
No. The foreign-based seller must register a U.S. business entity and obtain its own tax ID (EIN). All sales income and tax reporting flow through the company, not the PBR personally.
The PBR provides their SSN for identity verification purposes, not because they are the taxpayer for the business.
Important: To keep the PBR's personal taxes clean, your 1099-K and other tax documents must be issued to the company's EIN — not to the PBR's SSN. Work with a U.S. accountant to make sure this is set up properly.
So what is my PBR potentially liable for?
While the PBR is not the taxpayer, they are still the named U.S. representative of the business and can be exposed to:
- Product liability claims if someone is harmed by a product the shop sells.
- Regulatory actions (FTC, state Attorneys General, consumer protection agencies, customs).
- Lawsuits and subpoenas directed at the U.S. point of contact for the business.
Before working with Acutrack, before forming a U.S. entity, and before opening a TikTok Shop — identify your PBR first. Bring in someone from your own network, brief them honestly on the role, and structure the business to protect them.
